These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and Practical Objects, LLC, a Texas limited liability company doing business as Impulse Hosting ("Impulse Hosting", "we", "us"). By creating an account or using any Impulse Hosting service, you agree to be bound by these Terms, our Acceptable Use Policy, and our Privacy Policy.
Impulse Hosting provides the following categories of services:
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized access.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are using the services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Impulse Hosting operates infrastructure in multiple geographic regions, currently including Dallas (US), Newark (US), London (UK), and Singapore (SG). Data is stored and processed in the region(s) you select during provisioning. You are responsible for selecting regions that comply with any data residency requirements applicable to your use case.
The division of security and management responsibilities varies by service type:
Impulse Hosting manages: Server hardware, operating system, Plesk control panel, security patches, network infrastructure, automated backups, SSL certificates, and server-level firewall rules.
You manage: Website content, application code, CMS updates (unless using WordPress Toolkit auto-update), user accounts within Plesk, strong passwords, and compliance with laws applicable to your content.
Impulse Hosting manages: Physical infrastructure, hypervisor (for VPS), network connectivity, power, and hardware replacement.
You manage: Operating system, software installation, security patches, firewall configuration, data backups, access control, and everything inside the virtual machine or dedicated server.
Impulse Hosting manages: MinIO infrastructure, Nginx proxy, SSL certificates, storage availability, replication engine, and CDN layer.
You manage: Access key security, bucket policies (public/private), CORS configuration, data classification, and who you share credentials with.
Impulse Hosting manages: Database engine, host server, patches, automated backups (per plan tier), monitoring, and connection encryption.
You manage: Database schemas, queries, application-level access control, connection string security, and data within your databases.
All payments are processed through Stripe. By providing payment information, you authorize us to charge your payment method for all fees incurred. We also accept PayPal where available. All prices are in US dollars unless otherwise stated.
Services are billed in advance on a recurring basis (monthly, annually, or biennially depending on the plan selected). Your billing cycle begins on the date of your initial purchase.
If payment fails, we will attempt to collect payment and notify you. If payment remains outstanding for more than seven (7) days past the due date, we may suspend your services. Suspended services may be terminated and data permanently deleted after thirty (30) days of non-payment.
We offer a 30-day money-back guarantee on shared hosting plans (Website Hosting, WordPress Hosting, WooCommerce Hosting). Domain registrations, transfers, SSL certificates, VPS, bare metal, GPU, ImpulseDrive, and ImpulseDB services are non-refundable. Refund requests must be submitted via support ticket.
We may adjust pricing with at least thirty (30) days' written notice. Existing services will be billed at the current rate until the next renewal period.
Impulse Hosting targets 99.9% monthly uptime for all production services, measured as total minutes in the calendar month minus minutes of unplanned downtime, divided by total minutes in the month.
If we fail to meet the 99.9% uptime target for any service in a given month, you may request a service credit:
Credits must be requested within thirty (30) days of the incident. Credits are applied to future invoices and do not exceed one month's service fee. Scheduled maintenance windows are excluded.
The SLA does not cover downtime caused by: scheduled maintenance (announced at least 48 hours in advance), customer actions or configurations, force majeure events, DNS propagation, third-party service failures outside our control, or DDoS attacks.
Impulse Hosting performs daily automated backups of shared hosting accounts. These backups are provided as a convenience and are not guaranteed. You are responsible for maintaining your own backups.
No automated backups are provided unless you purchase a backup add-on. You are solely responsible for your data backup strategy.
Object storage data is stored with redundancy within the selected region. Cross-region replication is available on eligible plans. We do not perform separate backups of your stored objects.
Automated backups are included on applicable plan tiers with retention periods as specified in the plan documentation. You are responsible for verifying backup integrity and maintaining additional copies of critical data.
Upon service termination, your data will be retained for seven (7) days, after which it will be permanently deleted. You are responsible for exporting your data before termination.
If an ImpulseDrive service with active replication jobs is suspended for non-payment, replication jobs are paused immediately. After a seven (7) day grace period, destination replica buckets will be purged. A warning email is sent on Day 5 of suspension.
Your use of Impulse Hosting services is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violation of the AUP may result in suspension or termination of your account.
Domain registration services are provided through our registrar partner (eNom/Tucows). Domain registrations are subject to the applicable registry's terms and ICANN policies. Domain fees are non-refundable. You are responsible for maintaining accurate WHOIS information.
You retain all rights to your content. By using our services, you grant Impulse Hosting a limited license to host, store, transmit, and display your content solely as necessary to provide the services. We claim no ownership of your data.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMPULSE HOSTING'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IMPULSE HOSTING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify and hold harmless Practical Objects, LLC, its officers, and employees from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the services, your content, or your violation of these Terms or applicable law.
Either party may terminate services at any time. You may cancel through your client dashboard or by submitting a support ticket. We may suspend or terminate your account immediately for violation of these Terms or the AUP, non-payment, or if required by law. Upon termination, you remain responsible for any outstanding balance.
We may update these Terms from time to time. Material changes will be communicated via email to your registered address at least thirty (30) days before they take effect. Continued use of the services after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Dallas County, Texas. You consent to the exclusive jurisdiction of these courts.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right does not constitute a waiver. These Terms, together with the AUP and Privacy Policy, constitute the entire agreement between you and Practical Objects, LLC regarding the services.
